1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and VIPMaal ("we," "us," "our," or "VIPMaal"), governing your access to and use of the website https://vipmaal.com and all related applications, APIs, tools, and services provided by VIPMaal (collectively, the "Service").

By creating an account, connecting a mailbox, accessing our webmail client, or using any part of VIPMaal, you explicitly represent that you have read, understood, and agree to be bound by these Terms. If you do not agree to all terms and conditions set forth herein, you are strictly prohibited from using the Service.

2. Description of Services & Platform Architecture

VIPMaal provides a secure, centralized email synchronization platform that enables registered users to connect, manage, and read authorized email mailboxes. Features include:

• Google Gmail Synchronization: Integration with the official Google Gmail REST API via Google OAuth 2.0 for real-time, read-only inbox synchronization.
• Intelligent Dot-Alias Routing: Automated tracking and routing of Gmail dot variations (e.g., first.last@gmail.com), enabling isolated mailbox allocations capped at 25 lifecycle uses per address.
• Webmail Client: A unified webmail reader providing search, message inspection, and attachment viewing.
• Multi-Tier User Roles: Distinct operational roles for Administrators, Mailbox Owners (Sellers), and Authorized Users (Buyers) with segregated permission scopes.

3. Eligibility & Account Security

To access or use VIPMaal, you must be at least 18 years of age and possess the legal capacity to enter into a binding contract.

You are solely responsible for maintaining the confidentiality of your account credentials, passwords, and session tokens. You agree to notify us immediately at support@vipmaal.com of any unauthorized use or security breach of your account. VIPMaal is not liable for any loss or damage arising from your failure to safeguard your login credentials.

4. Google OAuth 2.0 Integration & Third-Party APIs

VIPMaal integrates with Google APIs using OAuth 2.0. By linking your Google account:

• You explicitly grant VIPMaal read-only authorization (gmail.readonly) to fetch and display message data within your authenticated dashboard.
• You acknowledge that our handling of Google user data strictly complies with the Google API Services User Data Policy, including the Limited Use requirements.
• You acknowledge that your Google data will never be sold, rented, transferred to advertising networks, or accessed by human personnel without your explicit authorization.
• You may revoke VIPMaal's authorization at any time either within the Service settings or through your Google Security Permissions Page.

5. Acceptable Use Policy & Prohibited Conduct

You agree to use VIPMaal solely for lawful, legitimate, and authorized purposes. You agree that you will NOT engage in any of the following prohibited activities:

1. Unsolicited Email & Spam: Utilizing VIPMaal in connection with transmitting bulk spam, unsolicited commercial emails, or fraudulent campaigns.
2. Phishing & Social Engineering: Attempting to deceive recipients, harvest login credentials, or spoof legitimate identities or institutions.
3. Malicious Code & Exploits: Uploading, linking, or processing messages containing viruses, worms, malware, spyware, Trojan horses, or any harmful code.
4. Unauthorized Access & Circumvention: Attempting to bypass access controls, probe system vulnerabilities, access another user’s mailboxes without authorization, or disrupt platform infrastructure.
5. Illegal Activities: Using the Service in violation of any applicable local, national, or international laws, regulations, or third-party intellectual property rights.
6. Automated Scraping & Reverse Engineering: Decompiling, reverse engineering, or mass-scraping platform assets, APIs, or database structures without explicit written permission.

Violation of this Acceptable Use Policy will result in immediate termination of your account, revocation of all mailbox permissions, and potential referral to law enforcement authorities.

6. Intellectual Property Rights

VIPMaal, including its source code, design systems, databases, trademarks, domain name (vipmaal.com), and logos, is the proprietary property of VIPMaal and is protected by copyright, trademark, and other intellectual property laws.

You retain full ownership of the email content, messages, and attachments belonging to your connected email accounts. You grant VIPMaal only a limited, non-exclusive license to process and display such data as necessary to provide the Service to you.

7. Privacy & Data Protection

Your privacy is paramount. Our data collection, encryption, storage, and retention procedures are set forth in our comprehensive Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimers of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

VIPMAAL DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, NOR DOES IT GUARANTEE THAT GOOGLE APIS OR THIRD-PARTY EMAIL SERVERS WILL REMAIN CONTINUOUSLY OPERATIONAL OR COMPATIBLE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VIPMAAL, ITS DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR INABILITY TO ACCESS OR USE THE SERVICE;
• ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THIRD-PARTY EMAIL PROVIDERS (INCLUDING GOOGLE GMAIL);
• ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR DATA; OR
• ANY BUGS, VIRUSES, OR MALICIOUS CODE TRANSMITTED THROUGH THE SERVICE BY THIRD PARTIES.

IN NO EVENT SHALL VIPMAAL’S AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00 USD) OR THE AMOUNT PAID BY YOU TO VIPMAAL IN THE PRECEDING SIX (6) MONTHS.

10. Indemnification

You agree to defend, indemnify, and hold harmless VIPMaal and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your unlawful use of the Service.

11. Suspension & Account Termination

We reserve the right to suspend or terminate your account and refuse any current or future use of the Service at any time, without prior notice or liability, for conduct that we believe violates these Terms, violates our Acceptable Use Policy, or is harmful to other users, third parties, or VIPMaal.

You may terminate your account at any time by contacting support@vipmaal.com. Upon termination, your right to use the Service will immediately cease, and your stored credentials and tokens will be permanently erased in accordance with our Privacy Policy.

12. Modifications to Terms

We reserve the right to revise or update these Terms at our sole discretion. If a revision is material, we will provide at least thirty (30) days' notice by posting a notice on the website or emailing your registered account address. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

13. Governing Law & Jurisdiction

These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the jurisdiction in which VIPMaal operates, without regard to its conflict of law provisions.
